Construction defects: the deadlines to know
For building works, the client has 60 days to notify the contractor of a defect; any agreement imposing a shorter deadline is void (Art. 367 para. 1bis CO). Claims become time-barred five years after acceptance of the works (Art. 371 para. 2 CO). Where the contract incorporates SIA standard 118, defects may be reported at any time during a two-year warranty period from acceptance.
That is why our service continues after the works: we follow up any warranty work for the period set by the SIA standards.
